1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Oak & Fable (“we,” “us,” or “our”) governing your access to and use of oakandfable.com (the “Site”) and any purchases made through it.

By accessing the Site or placing an order, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, please do not use the Site.

We reserve the right to update these Terms at any time. Continued use of the Site following any changes constitutes acceptance of the revised Terms. The “Last Updated” date at the top of this page reflects the most recent revision.

2. Products and Availability

Product Descriptions

We make every effort to display our products accurately, including colors, dimensions, and materials. However, we cannot guarantee that your screen will accurately reflect the true color of a product. Slight variations in color, grain, and texture are natural characteristics of wood and fabric furniture and are not considered defects.

Availability

All products are subject to availability. We reserve the right to discontinue any product at any time. If a product you ordered becomes unavailable after your order is placed, we will notify you promptly and offer a full refund or a suitable alternative.

Pricing

All prices are listed in US dollars and are subject to change without notice. We reserve the right to correct pricing errors at any time. If a pricing error affects your order, we will contact you before processing and offer you the option to proceed at the correct price or cancel for a full refund.

Prices do not include applicable taxes or shipping charges, which will be calculated and displayed at checkout.

3. Orders and Payment

Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is confirmed only when you receive an order confirmation email from us. We may cancel orders for reasons including product unavailability, pricing errors, suspected fraud, or failure to verify payment.

Payment

We accept major credit cards, debit cards, and other payment methods as displayed at checkout. Payment is processed securely through our third-party payment processor. By submitting payment, you represent that you are authorized to use the payment method provided.

We do not store full payment card details on our servers. All payment data is handled in accordance with PCI-DSS standards by our payment processor.

Sales Tax

Applicable sales tax will be calculated based on your shipping address and displayed at checkout. Oak & Fable is required to collect sales tax in states where we have nexus. Tax rates are subject to change in accordance with applicable law.

4. Shipping and Delivery

Shipping Methods and Timeframes

We offer standard and expedited shipping options where available. Estimated delivery timeframes are provided at checkout and are estimates only — they are not guaranteed delivery dates. Actual delivery times may vary due to carrier delays, weather, or other factors outside our control.

Large or heavy furniture items may be subject to freight shipping with curbside delivery. White-glove delivery and in-home assembly options may be available for select items at additional cost.

Shipping Charges

Shipping charges are calculated based on the weight, dimensions, and destination of your order and will be displayed at checkout before payment is collected. Free shipping promotions, where offered, apply only to orders meeting specified criteria and shipping to eligible addresses.

Risk of Loss

Title and risk of loss for products purchased from Oak & Fable pass to you upon delivery to the shipping carrier. If your order is damaged in transit, please contact us within 48 hours of delivery with photographic evidence and we will work with you to resolve the issue.

International Shipping

At this time, Oak & Fable ships within the United States only. International shipping is not currently available.

5. Returns and Refunds

Return Policy

We want you to love your purchase. If you are not completely satisfied, you may return most items within 30 days of delivery for a refund or exchange, subject to the conditions below:

• Items must be returned in original, unused condition in original packaging

• Items must be free of damage, odors, pet hair, or signs of use

• Custom, made-to-order, or personalized items are final sale and cannot be returned

• Items marked as Final Sale at time of purchase are not eligible for return

• Mattresses, bedding, and other hygiene-sensitive items may not be returned once opened

Return Process

To initiate a return, contact us at returns@oakandfable.com within 30 days of delivery. We will provide a return authorization number and instructions. Returns shipped without authorization may not be accepted. Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product.

Refunds

Once your return is received and inspected, we will process your refund within 5-7 business days to your original payment method. Original shipping charges are non-refundable unless the return is due to our error. Depending on your financial institution, refunds may take an additional 3-10 business days to appear on your statement.

Damaged or Defective Items

If you receive a damaged or defective item, contact us at support@oakandfable.com within 48 hours of delivery with your order number and clear photographs of the damage. We will arrange a replacement, repair, or refund at no additional cost to you.

6. Warranties

Oak & Fable warrants that products sold on our Site will be free from material defects in workmanship and materials under normal use for a period of one (1) year from the date of delivery, unless otherwise stated on the product page.

This warranty does not cover:

• Normal wear and tear

• Damage caused by misuse, accident, or improper assembly

• Damage caused by failure to follow care instructions

• Cosmetic damage including scratches, dents, or fading from sun exposure

• Commercial use of products sold for residential use

To make a warranty claim, contact us at support@oakandfable.com with proof of purchase and a description of the defect. We will repair or replace the defective item at our discretion. This warranty gives you specific legal rights, and you may also have other rights which vary by state.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, product photography, and software — is the property of Oak & Fable or its content suppliers and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our express written permission. Personal, non-commercial use for reference purposes is permitted provided attribution is maintained.

The Oak & Fable name, logo, and all related names and marks are trademarks of Oak & Fable. Nothing on the Site grants any right to use these marks without our express written permission.

8. User Accounts

You may create an account to access certain features of the Site including order history and saved preferences. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to terminate accounts that violate these Terms or are inactive for an extended period.

9. Prohibited Uses

You agree not to use the Site for any of the following purposes:

• Any unlawful purpose or in violation of any applicable laws or regulations

• Fraudulent transactions or impersonating another person or entity

• Scraping, crawling, or automated data collection without our express written consent

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OAK & FABLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Oak & Fable and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any third-party rights.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE SITE.
